The Process of Litigation

Litigation is a costly and, in some cases, a complicated process – even when you believe you are 100% in the right. It is vitally important to ensure you consult a Lawyer prior to proceeding with any matters of litigation.

So before you begin Litigation, you must ask yourself two very important questions:-

Firstly, what is the cost worth to you to see this matter to a “conclusion”? Secondly in a worst case scenario, what is your “conclusion”, i.e. how far are you willing to take this matter?

While the steps in a litigation matter vary from case to case, there is of course a basic process by which the legal system operates. It is important to remember, that at each stage of the process there is always additional costs such as Court Filing Fees, the cost of a Process Server, the cost of Expert Witnesses and reports if required or perhaps even a Barrister. These costs are over and above our professional fees but we will always detail these costs to you as each stage advances, and, we will never progress your matter without your expressed permission.

When a Judgment is obtained, the order for this debt lasts 12 years, sometimes with accruing interest in that time. This record is forwarded by the Courts to Veda Advantage, and recorded on the other parties’ credit rating. But a Judgment does not mean it is the end of the process. There is still a further stage, involving more costs to try and realise this debt from the debtor.

That is why you must consider all the steps in order to decide what “conclusion” you will be satisfied with.

Equally if you are being sued, you must be aware that you will have to defend your case to as far as the Plaintiff is prepared to take it.
